No Dismissal in Terror Case on Claim of Torture in Jail
A federal judge in Manhattan declined on Monday to dismiss charges against a man accused in a terrorism case whose lawyers claimed his rights were violated when he was tortured in secret jails run by the Central Intelligence Agency.The defendant, Ahmed Khalfan Ghailani, has been charged with conspiring in the 1998 bombings of two American embassies in East Africa. The attacks, which were carried out by Al Qaeda, killed 224 people. Mr. Ghailani later worked as a bodyguard for Osama bin Laden, the authorities have said.
After Mr. Ghailani was captured in 2004, he was held in the C.I.A.’s so-called black sites until 2006, when he was transferred to the naval base at Guantánamo Bay, Cuba. Last year, he became the first Guantánamo detainee moved into the civilian court system for trial.Although details of his treatment while in C.I.A. custody are classified, he has said in court papers that he was subjected to cruel “enhanced interrogation techniques.” His lawyers say that his treatment was unquestionably “torture,” and argued that the techniques were so “shocking to our traditional sense of justice” that charges should be dismissed on grounds of “outrageous governmental conduct.”“Indeed, while it is rare to find a case that is ‘so outrageous’ to warrant the ultimate sanction of dismissal,” his lawyers wrote, “if this is not such a case, then what is?”
But the judge, Lewis A. Kaplan of Federal District Court, ruled that Mr. Ghailani’s treatment while he was being detained had no relation to his court case.
“Even if Ghailani was mistreated while in C.I.A. custody and even if that mistreatment violated the due process clause,” the judge wrote, “there would be no connection between such mistreatment and this prosecution.”Judge Kaplan added that prosecutors should not be deprived of the opportunity to prove Mr. Ghailani’s guilt through the use of evidence “wholly untainted” by government misconduct.
“Any remedy for any such violation must be found outside the confines of this criminal case,” the judge said. The judge made no finding on whether Mr. Ghailani was tortured or otherwise mistreated.
In opposing dismissal of the charges, federal prosecutors have said there are more appropriate remedies to redress “the alleged government misconduct.”“Neither the manner by which a defendant is brought to court for prosecution nor the conditions of his confinement prior to that prosecution are valid grounds for dismissal of an indictment,” the United States attorney’s office wrote. Prosecutors have already said they will not use at trial statements Mr. Ghailani made while he was in detention.

Israel must propose its own peace initiative
Defense Minister Ehud Barak said on Monday that Israel must come out with a far-reaching peace initiative to improve its relations with the United States.
Speaking at the Knesset's Foreign Affairs and Defense Committee, Barak said, "a change is required in our relations with the United States ... Only a serious peace plan with the Palestinians can put an end" to the deterioration of this relationship.The new initiative must address the core issues of the Israeli-Palestinian conflict, he added."If the government cannot do this in its existing make-up, perhaps it should consider expanding," Barak said. "The continued occupation of another nation is no less dangerous that an entanglement with our worst enemies."At Labor's faction meeting later that day, MK Amir Peretz demanded that Barak, the party chairman, present the faction with a proper peace plan that would serve as the basis for
talks with the Palestinians once the proximity talks conclude. And should the proximity talks fail to lead to direct negotiations, he added, Barak must "be ready with a plan that will change Israel's political map"
Barak also told the Foreign Affairs and Defense Committee that the U.S. has altered its
approach to the Iranian nuclear threat and is now much more determined to face down Tehran.
"We see a change in the American approach," he said. "The [U.S.] administration is determined to prevent Iran from obtaining nuclear weapons. They are being much more
active."
And though he warned that Israel faces the risk of a "long-term erosion in its international standing," Barak said he does not think the new international push for a nuclear-weapons-free Middle East poses "a real or significant danger to Israel's traditional stance of nuclear ambiguity." happy new year

The speaker contends that with the development of technology, our traditional cultures will evaporate. I concede that the rapid development of technology has already given our lifestyle a radical change and has made the abyss between our racial stripe and the assimilated world smaller and smaller. Money for the Environment
Both the arts and protecting the environment are important causes, and both are often underfunded. They depend on government grants and private donations in order to continue. If a company were to give a sum of money to one of these causes, it would be difficult to choose between them. However, I believe that the company should put the money toward protecting the environment for the following reasons.
First, the state of the environment affects everyone, and it affects people in a very important way. If mankind destroys the environment, we will not be able to survive. The arts are important to our quality of life, but the environment is important both to the quality of life and to life itself. Second, because industry causes much of the damage to the environment, I believe that companies have some responsibility to support conservation and cleanup efforts. Finally, protecting the environment is a bigger problem, and so requires a higher level of funding than the arts. A company’s donation to the arts may be more visible, but one to the protection of the environment would be more meaningful.
In conclusion, while both the arts and environmental protection are worthy causes, I believe the company should make its donation to an environmental cause. The environment affects everyone in important ways and protecting it is a big job. Hopefully, private donations will help to improve both our environment and our lives.

What Can I Plant to Attract Bees and other Beneficial Insects to my Home Vegetable Garden?
We live in a society now where more vegetable gardeners then not look for natural means to grow safe and healthy food. Long gone are the days of using chemicals in the backyard vegetable garden to produce the food you want to put on the table for your family.
If you are one of those vegetable gardeners that think the non chemical means is a harder more labor intensive way to grow vegetables, you would be right. Well sort of. The labor will come from all of those beneficial insects, bacteria, worms and other creatures you are going to attract to your vegetable garden, and they will be the ones that actually do the work.
For instance, if you bury your left over supper in your ground (at least 18 inches deep), there is an underlying ecosystem beneath the soil such as microbial, bacteria, and worms that will break that dinner down into useable healthy compost. All you had to do was dig the hole, drop your left overs in, cover the hole and walk away. Not very hard now was it?

A letter form my penpal-Qing
Good to hear that you have "survived" the cold. I'm feeling better now except for cheap polo shirts in the throat but of course that does not stop me from writing to you. Meanwhile, i'm very impressed that you have done so well for your writing homework, i am sure it is the result of your ralph lauren polo shirts.
As a student, i never offend the teacher personally .In GP lessons during the 2 years in junior college (JC), when we have to discuss cheap ralph lauren polo shirts, i will be very responsive. Just to let you know, in GP (General Paper) lessons, other than doing comprehension section with extremely long passage and difficult questions, we have to write essays with topics such as "Beauty is in the eyes of the beholder.Comment" and "Is war always undesireable?". Of course it covers many other areas as well. Therefore during the lessons we will have to debate, sometimes i will speak out if i disagree with the teacher's ideas, even if it means speaking against her.:-)) cannot help it when my mouth sets me running around. However i think this is the purpose of holding a debate.......which really helps in brainstorming.

Growing Up
Growing Up
Growing up has taught me
Many things-sweet and bitter.
I cherish the sweet ones,
And dump the others.
In the attic of my soul.
But, when I am down and unhappy
When my mind is storm-ridden,
They crawl one by one-
Down the stairs of the attic
To stone my spirit-
With taunts and fears infinite
I had tried desperately to forget.
Growing up has taught me

Cherish rest of your life
It's hard, from within the storm of every day life, to see things with real perspective, to know what's important and what's simply pressing on our consciousness right now, demanding attention.
We have people emailing us for information and requesting action, we have phone calls and visitors and a long to-do list and a million chores and errands to run and all of the slings and arrows of our daily reality … and yet, what is important?
Ask yourself this: if you suddenly found out you only had 6 months to live (for whatever reason), would the thing in front of you matter to you?
Would those 20 emails waiting for a response matter? Would the paperwork waiting to be processed matter? Would the work you're doing matter? Would the meetings you're supposed to have matter? Would a big car and nice house and high-paying job and cool computer and mobile device and nice shoes and clothes matter?
I'm not saying they wouldn’t matter … but it's important to ask yourself if they would.
What would matter to you?
For many of us, it's the loved ones in our lives. If we don't have loved ones … maybe it's time we started figuring out why, and addressing that. Maybe we haven't made time for others, for getting out and meeting others and helping others and being compassionate and passionate about others. Maybe we have shut ourselves in somehow. Or maybe we do have loved ones in our lives, but we don’t seem to have the time we want to spend with them.
When was the last time you told your loved ones you loved them? Spent good quality time with them, being in the moment?
For many of us, doing work that matters … would matter. That might mean helping others, or making a vital contribution to society, or creating something brilliant and inspiring, or expressing ourselves somehow. It’s not the money that matters, but the impact of the work. Are you doing work that matters?
For many of us, experiencing life would matter — really being in the moment, finding passion in our lives, seeing the world and traveling, or just seeing the world that’s around us right now, being with great people, doing amazing things, eating amazing food, playing.
These are just a few ideas … but what would matter to you?
I highly recommend that you spend at least a little time now, and regularly, thinking about this question … figuring out what really matters … and living a life that shows this.
How do you live a life that puts a great emphasis on what matters? Start by figuring out what matters, and what doesn't. Then eliminate as much as you can of the stuff that doesn't matter, or at least minimize it to the extent possible. Make room for what does matter.
Make the time for what does matter … today. Put it on your schedule, and don't miss that appointment. Make those tough decisions — because choosing to live a life that is filled with the important stuff means making choices, and they’re not always easy choices. But it matters.
Spend time with your significant other, show them how important they are. Take the time to cuddle with your child, to read with her, to play with her, to have good conversations with her, to take walks with her. Take time to be in nature, to appreciate the beauty of the world around us. Take time to savor the little pleasures in life.
Because while you might not have only 6 months to live, I'm here to break the news to you: you really do only have a short time to live. Whether that's 6 months, 6 years or 60 … it's but the blink of an eye.
The life you have left is a gift. Cherish it. Enjoy it now, to the fullest. Do what matters, now.

The Miss of Love
Wherever you are I'll always be here waiting for the day we can once meet again.
The miss of a lost love can darken the soul. Wishing to see her in the moonlight or day can cause pain and it does in my heart. Her walk was of a God and her eyes were of the dove Lost am I in this world without her. Her touch her sound the kiss of forever and the words that came to be.
She died in my arms, and the pain will never go away. Some nights I cry praying for her to be here, but only alone I come to be. If only someone knew how the pain burns like fire slowly burning the heart. Tears are the only memory of her and her smile.
No cure could be found and it was only up to God's time. So many things I still wanted to say to her and so much to do with so little time. Like to take a walk through a park and hold hands as the birds fly free with the wind or to make love on a beach as the waves crash to the shore. She was my true love and to see her go away kills my soul.
I did all I could to make her time happy, we talked about memories and stories, went to the tree outside our house were I asked her to marry me, but most of the time I just watched her get sicker and sicker and on the day of her death I blew out the candle of our dreams never to light it again.
Wherever you are I'll always be here waiting for the day we can once meet again. For when the day comes tears of the past will be gone and tears of the future will lead the way.
